This document is an internal draft and must be reviewed by legal counsel before publication.
1. Purpose
These terms of use (the "Terms") set out the rules for accessing and using the Examia platform, available at examia.tech and through its official iOS and Android applications (the "Service").
The Service is an online preparation platform for candidates taking the TCF Canada: practice sessions, Written Expression and Spoken Expression simulators with AI-assisted marking, learning content and progress tracking.
Financial terms (prices, subscriptions, credits, refunds) are set out separately in the terms of sale.
2. No affiliation
Examia is an independent prep platform. It is not affiliated with, accredited by, or endorsed by France Éducation international, which designs the TCF Canada, nor by Immigration, Refugees and Citizenship Canada (IRCC). "TCF" is used descriptively only, to identify the exam the Service prepares you for.
Examia does not run exam sessions, does not issue official certificates, and plays no part in registering for, running or marking the TCF Canada. Exam registration must be done through an accredited test centre.
3. Acceptance
Using the Service means accepting these Terms in full. Acceptance is given by creating an account or, without an account, by browsing the public pages of the Service.
If you do not accept these Terms, you must stop using the Service.
4. Access and minimum age
Access requires an internet connection and a recent browser or the official mobile app. Connection costs are yours.
The Service is for people aged 16 and over. A person aged 16 or over who has not reached the age of majority may use the Service only with the prior consent of a parent or guardian, who is deemed to accept these Terms on their behalf. Examia may ask for confirmation of that consent and suspend the account if none is given.
5. Your account
Creating an account requires a valid email address and, depending on the sign-up method, a password or authentication through a third-party provider.
You agree to give accurate information and keep it up to date. You are responsible for keeping your credentials confidential and for all activity carried out from your account. Report any suspicious use to support@examia.tech.
Account rules:
- One account per person. Opening several accounts as the same individual, in particular to stack trial periods or free credits, is not allowed.
- No sharing. The account is strictly personal. Lending, reselling, renting or otherwise giving your credentials to another person, for payment or free of charge, is not allowed.
- Two simultaneous devices at most. A session may be open on two devices at once. When a third device signs in, the oldest session is automatically revoked. This is a sharing control, not a complete security feature.
6. Content made available
Practice topics, model answers, marking grids, study sheets, transcripts and audio recordings provided in the Service are protected by copyright and, where applicable, database rights.
You are granted a personal, non-exclusive, non-transferable and revocable right of use, limited to the duration of your access and to your own individual preparation.
The following are not allowed without prior written permission:
- reproducing, distributing, publishing or reselling any part of the content, including on messaging groups, file-sharing spaces or other platforms;
- systematic extraction or exhaustive downloading of the content, by automated or manual means;
- building a competing database from the content;
- using the content to train a machine-learning model.
Content served to you carries a personal watermark identifying the account it was served to. It traces the origin of a leak and must not be removed, hidden or altered.
7. Your submissions
You keep ownership of the texts, audio recordings and other content you submit to the Service (your "Submissions").
You grant Examia a non-exclusive licence, limited to the lifetime of your account, to host your Submissions, pass them to the technical providers needed to mark them, and produce transcripts and corrections from them. This licence exists only to run the Service.
Your Submissions are not published, distributed, or used for advertising. Anonymised use to improve marking grids happens only with your consent, collected separately and revocable.
8. Status of AI-generated scores
Scores produced by our simulators are estimates generated by artificial intelligence and calibrated on teacher-marked papers. They are in no way an official result.
No guarantee is given that the estimate shown matches the level you actually achieve at the real exam. The official result depends solely on accredited test centres and France Éducation international.
The comments and detailed grids delivered with an estimate are automated teaching feedback, not personalised advice.
9. Prohibited conduct
In addition to the breaches already listed, the following are prohibited:
- attempting unauthorised access to the Service, its administration interfaces or other users' data;
- using bots, scripts, extensions or any automated means to interact with the Service outside the intended interfaces;
- circumventing quotas, credit limits, watermarks or device controls;
- submitting unlawful, abusive or discriminatory content, or content infringing third-party rights;
- any action likely to disrupt the operation or availability of the Service.
10. Availability and changes
Examia works to keep the Service continuously available, without an obligation of result. Interruptions may occur for maintenance, updates, technical incidents or provider failures.
Examia may change the features of the Service. If a substantial feature covered by an active paid plan is withdrawn, the cancellation provisions of the terms of sale apply.
11. Suspension and termination
You may close your account at any time from your account settings. The effect on your data is described in the privacy policy, and the financial effect in the terms of sale.
Examia may suspend or terminate an account for breach of these Terms, after notice and, where the situation allows, after a period to put things right. Credential sharing, mass content extraction and payment fraud are grounds for immediate suspension. If a suspension turns out to be unjustified, access is restored and the paid period extended by the same duration.
12. Liability
Examia is liable for performing the Service under ordinary law. It is not liable for the result a candidate obtains at the real exam, for any decision of an immigration authority, or for the consequences of using the Service in breach of these Terms.
Nothing here limits the rights that mandatory consumer-protection rules give you.
13. Personal data and cookies
The processing of your personal data is described in the privacy policy. Trackers are described in the cookie policy.
14. Changes to these Terms
Examia may amend these Terms. Any substantial change is notified by email or in-Service at least thirty days before it takes effect. Continuing to use the Service after that date constitutes acceptance. If you do not accept, you may close your account under the terms of sale.
15. Governing law and disputes
These Terms are governed by French law.
In case of a dispute, send a complaint first to support@examia.tech. If no solution is reached within sixty days, you may use a consumer mediator free of charge; the competent mediator's details appear in the terms of sale and are provided on request.
The European Commission provides an online dispute resolution platform: https://ec.europa.eu/consumers/odr.
If you live outside France, the mandatory consumer-protection rules of your country of habitual residence still apply and are not displaced by the choice of French law.
